Public Notice: Proposed Amendment To Section 59 CPA Agreement

Public Notice is hereby given that the Quispamsis Town Council has been requested to and intends to consider a request to amend a Section 59 Community Planning Act development agreement, concerning the following previously rezoned Multiple Residential property: 

LOCATION: A parcel of land situated on the corner of the Hampton Road and Pinewood Crescent, identified as PID No. 251959 with Civic No. 258 Hampton Road, consisting of 16,875 sq. meters; with access off the Hampton Road. (as illustrated)

REASON FOR CHANGEThe owners, Elms 258 Hampton Holdings Inc., are requesting the agreement to be amended in order to make the project more feasible with regards to affordable housing needs and rising construction costs. The proposed development would include 160 units (formerly 100) contained within three buildings (formerly two buildings), two 4-storeys and one 3-storey. In order to increase the buffer - trails and pickleball court has been eliminated from plan. The amendment will also require the following additional variances to the R2 zone in the Quispamsis Zoning Bylaw for this site:

  1. Variance to Clause 9(B)(1) to reduce the minimum lot frontage to 140 metres.
  2. Variance to Clause 9(C)(1) to allow a minimum floor area of 37 square metres for one-bedroom units.
  3. Variance to Clause 9(I)(1) to allow a minimum parking ratio of 0.75 spaces per unit

ENGAGEMENT:

The Planning Advisory Committee (PAC) will consider this application at the September 10, 2024 PAC Meeting at 6:00 p.m.  in the council chambers of the Quispamsis Town Hall, 12 Landing Court, Quispamsis, New Brunswick. A Public Hearing of the proposed amendment will be held September 17, 2024 at 6:00 p.m.  in the council chambers of the Quispamsis Town Hall, 12 Landing Court, Quispamsis, New Brunswick, where Council will hear and consider any objections to the proposed amendment.

Written comments may be made to the Council in care of the undersigned and submitted no later than September 12, 2024 by 1:00 p.m.

The proposed amendment may be inspected by any interested person during regular office hours, 7:30 a.m. to 5:00 p.m., Monday to Friday inclusive, at the Quispamsis Town Hall, 12 Landing Court, Quispamsis, New Brunswick.
