Proposed Amendment to Section 59 Community Planning Act Developer’s Agreement

PROPOSED AMENDMENT TO SECTION 59 COMMUNITY PLANNING ACT
DEVELOPER’S AGREEMENT

Public Notice is hereby given that the Quispamsis Town Council has been requested to and intends to consider amending the agreement entered into between the town of Quispamsis and Andrew Edwin McKay, dated October 1, 2018, under Section 59 of the Community Planning Act.  The agreement outlines the terms and conditions of the previous Multiple Residential (R2) rezoning of approximately a  1.8 acre parcel of land, identified as PID No. 00252403 with Civic No. 309 Hampton Road, as shown on the A. E. McKay Builders Ltd.’s plan, “Proposed 42 Unit Apartment Complex Plan”, prepared by Comeau MacKenzie Architecture, and dated January, 2018.

REASON FOR CHANGE:   To allow the project to be completed on a phased approach that would see Phase 1 include construction of the building containing thirty three, (33 units),  and all the site work, and Phase 2 to include the remaining nine (9) units when market conditions are conducive to this addition.  The construction start date for Phase I of the project is prior to April 30, 2020.  The proposed amendment is in keeping with the original overall development proposal for the property as agreed to in the current agreement.  The total number of units on the property remains the same, and there is no change in the location or height of the building.  The proposed change is to the length of the building toward the Hampton Road, with that portion where the construction of the nine units being delayed until Phase 2 as indicated above.

A Public Hearing of the proposed Zoning By-law Amendment will be held December 17, 2019 at 7:00 p.m., in the council chambers of the Quispamsis Town Hall, 12 Landing Court, Quispamsis, New Brunswick, where those wishing to speak for or against the proposed amendment will be permitted to do so.        Written objections to the proposed change to the agreement may be made to the Council in care of the undersigned and submitted by 1:00 p.m., Thursday, December 12, 2019.

The proposed amendment may be inspected by any interested person during regular office hours, 8:00 a.m. to 4:30 p.m., Monday to Friday inclusive, at the Quispamsis Town Hall, 12 Landing Court, Quispamsis, New Brunswick.
